Sudan-born man charged with alleged visa breaches in Victoria

A Sudan-born man is expected to appear in the Melbourne Magistrates Court today (24 February, 2026) charged with allegedly failing to comply with his visa-mandated conditions and breach of bail offences.

The AFP charged the man, 39, today (24 February 2026), after he was located in Melbourne.

It will be alleged the man breached the conditions of his Commonwealth visa by failing to maintain his device, as well as committing an indictable offence while on bail.

The man has been charged with:

  • One count of failing to maintain his electronic monitoring device contrary to section 76D(3) of the Migration Act 1958 (Cth);
  • One count of possessing cannabis contrary to section 73 of Drugs Poisons and Controlled Substances Act 1981 (Vic); and 
  • One count of committing an indictable offence whilst on bail, contrary to section 30B of the Bail Act 1977 (VIC);

The migration act offence carries a maximum penalty of five years' imprisonment and/or a $99,000 fine.
