Afghanistan-born man charged over two alleged visa breaches in Victoria

An Afghanistan-born man is set to appear before Melbourne Magistrates’ Court tomorrow (2 February, 2026) charged for allegedly failing to comply with his visa-mandated conditions. 

The AFP charged the man, 32, yesterday (31 January, 2026), after he was located in Melbourne, Victoria.  

It will be alleged the man breached one of the conditions of his Commonwealth visa by failing to report to the Department of Home Affairs, as directed.

The man has been charged with two counts of failing to comply with a requirement of his monitoring condition pursuant to section 76B of the Migration Act 1958 (Cth).

This offence carries a maximum penalty of five years’ imprisonment and/or a $99,000 fine for each count.
